Judge throws out lawsuit challenging Ann Arbor schools' gun ban

A Washtenaw County trial court judge has dismissed a lawsuit against an Ann Arbor Public Schools policy banning guns on school property.

The Ann Arbor School Board voted unanimously to ban guns on school grounds after a man openly carried a pistol to a school performance last spring.

Michigan Gun Owners and Ann Arbor parent Ulysses Wong filed suit against the district shortly after the policy was enacted.

Their attorney, Jim Makowksi, said during Wednesday's court proceedings that the school district had violated a state law that prohibits government entities from regulating firearms.

However, Judge Carol Kuhnkesaid the law clearly defines "a local unit of government" as "a city, village, township, or county."

Makowski said he intends to appeal the ruling.

"It's my opinion that [Kuhnke] didn't follow the law. I think that she exercised a bit of judicial activism," Makowski said.

The ruling comes a little more than a month after a Genesee County judge ruled in favor of a Clio-area man who sued that district over a similar gun ban policy.
